The Arizona Department of Gaming states that only certain games styled as free-to-play are lawful in Arizona and warns that some can amount to illegal gambling. In addition, it points to Arizona’s gambling statutes and explains that “sweepstakes” is not itself a defined term in Arizona law.
Arizona Revised Statutes §13-3301 defines gambling around risking or giving something of value for an opportunity to obtain a benefit from a game, contest or future contingent event. Meanwhile, Section 13-3302 lists categories of conduct that are not unlawful under the gambling chapter, including amusement, social and regulated gambling when their requirements are met.
For example, for free-to-play or sweepstakes-style promotions, the Department says the free route must genuinely remove consideration. In addition, its guidance says free participants should be able to participate in the same manner, to the same extent and with the same odds as people who contribute or purchase, without extra requirements or limitations placed on the free route.
Therefore, this guide does not translate a casino’s Arizona availability into a statement that the platform is licensed, approved or definitively legal. Operator rules and the facts of a specific promotion still matter.
