KRS 528.010 defines gambling around staking or risking something of value on a contest, game, scheme or device involving chance with the understanding that someone will receive something of value from a particular outcome. The statute also contains specific exclusions and related definitions for gambling devices, lotteries and other activity.
Sweepstakes-style casinos generally separate entertainment-only currency from promotional prize play and provide no-purchase participation routes. That structure is relevant to how the product is presented, but it does not amount to a Kentucky casino license or guarantee that every operator, promotion or account use will be treated the same way under Kentucky law.
Kentucky has also seen active sweepstakes-related litigation in 2026. American Casino Sweeps reported 13 proposed statewide class-action complaints filed in federal court over two days in July. Those complaints contain allegations only and should not be read as rulings that every named platform is unlawful.
The practical distinction is between
current operator availability
and
state authorization.
A platform should not be described as Kentucky-licensed unless an authoritative state source supports that claim.
